Marketplace Work Agreement

This agreement applies to every Poster and Provider who uses Cheshub to arrange work. It sits alongside the Terms & Conditions and does not make Cheshub a party to the contract for the work.

1. Agreement between Poster and Provider

When a Poster accepts a Provider quotation, appoints a Provider, asks the Provider to commence work, or otherwise clearly agrees through Cheshub or related communications that work will be carried out, the Poster and Provider intend to form a direct agreement with each other for that work.

2. Poster payment commitment

The Poster agrees to pay the Provider all sums properly agreed for work that is authorised and carried out in accordance with their agreement. This includes any agreed deposit, advance payment, staged or milestone payments, payments due on completion, hourly charges, fixed prices, materials, approved variations or other amounts expressly agreed between the Poster and Provider.

3. Provider performance commitment

The Provider agrees to carry out accepted work in accordance with the scope, price, timescale, quality requirements and payment arrangements they agree with the Poster, subject to applicable law and any later variation agreed by both parties.

4. Payment terms must be agreed

Before significant work starts, users should clearly record the agreed scope, price and payment schedule. If payment is to be made by deposit, phases, milestones, hourly billing, on completion or another arrangement, the parties are responsible for agreeing that arrangement clearly.

5. Variations and additional work

Additional work or changes outside the original scope should be agreed before being carried out wherever reasonably possible. Users should record any effect on price or timescale.

6. Non-payment and disputes

If a Poster fails to pay an amount properly due, the Provider may pursue the Poster directly using the remedies available under their agreement and applicable law. If a Provider fails to perform the agreed work properly, the Poster may pursue the Provider directly under their agreement and applicable law. Cheshub is not responsible merely because one user fails to pay, perform, attend, complete, refund or otherwise comply with their agreement.

7. Cheshub does not collect or guarantee payment

Unless a separate Cheshub payment product is expressly introduced for a transaction, Cheshub does not collect deposits, hold money, guarantee payment, guarantee performance or act as escrow. Users are responsible for selecting appropriate payment methods, deposits, staged payments and credit-risk safeguards.

8. Due diligence remains required

This agreement does not replace users' responsibility to check identity, suitability, qualifications, licences, insurance, references, ability to pay, scope, price and other matters relevant to the work.

9. Electronic acceptance

By electronically signing this Marketplace Work Agreement during registration, the user confirms that they intend their electronic acceptance to authenticate and bind them to this agreement for their use of Cheshub. Transaction-specific terms remain the terms actually agreed between the Poster and Provider for each job.

10. Applicable law

This agreement is subject to the law of England and Wales and to any mandatory consumer or other statutory rights that cannot lawfully be excluded or restricted.
